Shoreland Zoning, Shoreland Erosion Control and Mitigation Permitting

Wisconsin statutes require every county in the state to adopt an ordinance that regulates development along shorelands and waterways in order to protect water quality, scenic beauty, fish and wildlife habitats.

Every County has slightly different regulations that must be followed when constructing a new home, rebuilding a home or developing land near sensitive waterways. In Dane County, the process can be cumbersome.

In Dane County, the general shoreland zone is defined as within 300 feet of any navigable waterway. Impervious surfaces may not exceed the current percentage of the lot or 15%, whichever is greater. Before the County will issue a general zoning permit and before a township will issue a building permit, a shoreland zoning permit needs to be approved. Part of that approval requires obtaining a shoreland erosion control permit typically stamped by a licensed professional engineer. Additionally, a shoreland mitigation permit with a vegetated buffer restoration plan may be required depending on the project.
